The
Housing Division administers State laws and has adopted rules
concerning mobile home park leases, rent increases, and sale or
closure of mobile home parks, conducts an annual registration
of parks, and has adopted rules for the warranty of habitability
contained in the statute, but does not have explicit authority
to enforce those sections, and publishes a Mobile Home Parks Report
periodically.

not require cement pads. Some towns may have zoning ordinances
regulating foundations, and some lenders may require a pad before

committee bill was enacted into law and became effective
September 1, 2010. The bill clarifies the rights and obligations
of sellers and owners of a mobile home, amends the mobile home
uniform bill of sale, and establishes requirements for mobile
home sales transactions.

The
Department contracts with the Champlain Valley Office of Economic
Opportunity (CVOEO)
Mobile Home Project to provide support services to residents
faced with the possible sale of their mobile home park, notice
the park will be closed, rent increases more than 1% above the
housing component of the consumer price index (for 2012 = 2.60%),
and other significant park-wide issues.

Vermont's
statutes and rules provide significant protections to mobile
home park residents. MHP residents are entitled through
their lease and Vermont law to premises that are safe, clean
and fit for human habitation, including: adequate and reliable
utility services; safe electrical service; potable water and
sewage disposal to a location on each lot from which the mobile
home may be connected; and safe and fit roads, common areas
and facilities.

* Legislation effective July
1, 2008 significantly amended the Mobile Home Park Act. The
Department expects to update the Rules in the future. Until
the Rules can be updated, refer to the amended statute wherever
the Rules and statute are inconsistent.
Residents are also entitled
to: A written lease; proper notice sixty days in
advance of any rent increase, and mediation of certain increases
(for 2012 any increase above 2.60%); peaceful enjoyment of their
home and the park; privacy (park owner's compliance with law
on his or her access to the lot); the right to sell or sublet
the mobile home; not to be evicted except for cause; i.e. nonpayment
of rent or lease violations; and proper notice of the owner's
intent to sell or close the mobile home park.

Includes Rented MHs and Lots Not
in MHPs
The State Rental Housing Health
Code was updated in 2006. The revised code include provisions
important to people who rent a private lot for their mobile
home and people who own private lots that are not located
in a mobile home park. The State Rental Housing Health Code
is enforced by the Town Health Officer. more

Manufactured or "mobile homes"
are built to pre-emptive federal standards of the Department
of Housing and Urban Development (HUD). These standards are
referred to as the "HUD code". Vermont like over a
dozen other states does not regulate installation and set up
or construction problems with mobile homes. We refer consumers
needing assistance to HUD's Manufactured
Housing Office. If you have a question or a problem with
a new mobile home, retailer or dealership please contact HUD's
Manufactured Housing Office or the Vermont Attorney General's
Consumer Assistance Program.
What
is the difference between 'modular' and 'manufactured' housing?

HUD's Model Manufactured Housing
Installation Standards Rule became effective on October 20,
2008. This rule only applies to the initial set up of new mobile
homes. The mobile home dealer / retailer or distributor is responsible
for ensuring proper set up. more

HUD's dispute
resolution program became effective on February 8, 2008.
The purpose of this program is to resolve questions between
manufacturers, dealers and installers of responsibility for
defects in new manufactured homes reported within one year of
installation on a voluntary basis outside of the regulatory
environment. Information is provided with any new manufactured
home.
