Changes to Chapter 117 (Act 115)

As of September 1, 2005, a number of the revised sections of Chapter 117 override language in municipal bylaws that is inconsistent because it has not been revised to reflect the legislative changes. The Guidance Document: Life as of September 1, 2005 (revised October 3, 2005) will assist in decision-making when the local and state statute language conflict.

A comprehensive update of 24 V.S.A., Chapter 117, was signed into law in May 2004. The new provisions of Chapter 117 were enacted as a part of the Act 115 permit reform law.

DHCA is working with partners in the Land Use Education and Training Collaborative to help municipalities adapt to these statutory changes. In 2001, The Vermont General Assembly formed a commission to review Chapter 117, Vermont's Municiapl and Reguional Planning and Development law, and recommend changes to encourage and promote responsible development of affordable housing throughout Vermont. After fulfilling the legislative mandate through issuance of “Affordable Housing Under 24 V.S.A Chapter 117” (.pdf 312 KB) the commission convened for a second year to complete a comprehensive update of Chapter 117's zoning, subdivision and other land use implementation tools.
